01. About this website

This website is operated by Serena Bifolchi, an independent artist and artisan with ateliers at Via San Pietro 7, Siena, and Via di Gracciano 109, Montepulciano, Italy. The site presents Serena's work and provides contact information for those wishing to commission a painting or visit in person.

No products are sold directly through this website. All purchases are arranged individually, either in person at one of the ateliers or through direct correspondence.

02. Commissions

Commission enquiries are made by contacting Serena directly via email or WhatsApp. Each commission is treated as a bespoke agreement. The specific terms — including price, timeline, dimensions, materials, and payment method — are established individually for each commission and communicated in writing prior to any work commencing.

Given the handmade nature of each piece and the use of natural pigments, minor variations from any sketch, reference, or previous work are inherent to the process and do not constitute a defect.

Serena reserves the right to decline any commission at her discretion, with no obligation to provide a reason.

03. Payment & deposits

Payment terms are agreed per commission. For larger or more complex works, a deposit may be required before work begins. The amount and method of payment will be confirmed in writing during the commission correspondence.

For clients based outside Italy, payments may be made by bank transfer or other methods agreed in advance. Any applicable taxes, import duties, or customs charges at the destination are the sole responsibility of the recipient.

04. Shipping & delivery

Commissioned works may be collected in person from either atelier or shipped. International shipping is available. All paintings are packaged by Serena personally. Estimated delivery timelines, shipping costs, and carrier options are discussed and confirmed as part of the commission agreement.

Serena takes all reasonable care in packaging. Once a painting has been handed to a courier, responsibility for transit passes to the shipping carrier. Serena is not liable for delays, losses, or damage caused during transit, though she will assist in any reasonable way with claims where possible.

It is the client's responsibility to ensure that importing the work into their country is lawful and to comply with any applicable local regulations.

05. Cancellations & returns

Because each painting is made to order using irreversible natural materials, cancellations after work has commenced may result in forfeiture of any deposit paid. The specific cancellation policy for a given commission will be stated in the written agreement.

Returns are not accepted for completed commissions unless the work is materially different from what was agreed in writing. Any dispute must be raised within fourteen days of receipt.

For paintings purchased directly in person at the atelier, no return or exchange is offered once the sale is complete.

06. Intellectual property

All images, text, and artwork on this website are the property of Serena Bifolchi and are protected under applicable Italian and international copyright law. Reproduction, distribution, or commercial use of any content from this website without prior written consent is prohibited.

Purchasing or commissioning a painting transfers physical ownership of the object only. All copyright and reproduction rights remain with Serena Bifolchi unless explicitly agreed otherwise in writing.

07. Limitation of liability

The information on this website is provided in good faith for informational purposes. Serena Bifolchi makes no warranties, express or implied, regarding the completeness or accuracy of its content. To the fullest extent permitted by law, Serena Bifolchi is not liable for any indirect, incidental, or consequential loss arising from the use of this website or from any commission arrangement.

08. Governing law

These Terms are governed by and construed in accordance with the laws of Italy. Any disputes arising from use of this website or from a commission agreement shall be subject to the exclusive jurisdiction of the courts of Siena, Italy, unless otherwise required by mandatory consumer protection provisions applicable in the client's country of residence.

09. Changes to these terms

These Terms may be updated from time to time. The current version will always be available on this page. Continued use of the website following any update constitutes acceptance of the revised Terms.
